Who we are. beU Global Inc. ("beU", "we", "us", "our") operates the beU online store (the "Site") and sells sexual‑wellness products and accessories under the beU™ brand. beU™ is a brand of beU Global Inc. References to "beU" in these Terms mean beU Global Inc. and, where applicable, its affiliates and brands (including the "beU" brand).


Overview

Welcome to beU! The terms “we”, “us” and “our” refer to beU. We operate this store and website, including all related information, content, features, tools, products and services to provide you with a curated shopping experience (the “Services”). beU is powered by Shopify, which enables us to provide the Services to you. These Terms, together with the policies referenced herein, describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy (see Privacy Policy). If you do not agree, do not use or access the Services.

 

 

Acceptance of these Terms

By accessing or using the Site, creating an account, or purchasing products, you agree to these Terms. If you do not agree, do not use the Site.

 

 

Age Requirement (18+)

This Site is intended for adults. You must be 18 years or older to view or purchase. In certain jurisdictions (e.g., some U.S. states), you must be 21+. We may use age‑gating and may cancel or refuse orders that appear to violate this policy. Minors are not permitted to use the Services. If you are under the minimum age where you live, leave immediately.


Territory, Language & Eligibility

We currently sell and ship to Canada and the United States. Additional regions (EU/EEA, United Kingdom, Australia) may be enabled later. These Terms are provided in English; translations may be offered for convenience only.

 

Access & Account

To use the Services (including browsing or purchasing), you may be asked to provide information such as your email address, billing, payment, and shipping details. You represent and warrant that the information you provide is accurate, current, and complete and that you have all rights necessary to provide it. Keep your credentials confidential; you are responsible for all activity under your account. You may not transfer, sell, assign, or license your account to any person.

 

Our Products

We aim to represent products accurately; however, colours/appearance may vary due to device settings and manufacturing tolerances. We do not warrant that appearance or quality will meet your expectations. Descriptions are subject to change without notice; we may discontinue products or limit quantities by person, region, or jurisdiction.

 

Orders & Availability

When you place an order, you make an offer to purchase. We may accept or decline any order at our discretion for reasons including suspected fraud, errors, or stock limits. Orders are accepted upon our confirmation and successful payment processing. We may be unable to accommodate cancellations after acceptance. If we do not accept or we cancel an order, we will attempt to notify you at the contact details provided and will refund any amounts charged. We may offer pre‑orders/backorders; estimated ship dates are not guaranteed. We follow the U.S. Mail, Internet, or Telephone Order Merchandise Rule where applicable.

 

Prices, Billing, Taxes & Duties

Prices, discounts, and promotions may change without notice. The price charged is the price in effect at the time of order and will appear in your order confirmation. Unless expressly stated, prices exclude taxes, shipping/handling, customs and import charges. Prices online may differ from other channels. Promotions may be governed by separate terms; if there is a conflict, the promotion terms control. You agree to keep your purchase, payment and account information current. You represent and warrant that your payment method is valid and authorized, and that you will pay all charges including applicable taxes and fees.

 

 

Payments

We accept Shopify Payments (and any other methods shown at checkout). By submitting a payment method, you authorize us and our processors to charge the order total, including shipping, taxes, and duties. All payments are subject to processor terms and fraud screening. We do not store full card numbers.

 

 

Fraud Prevention & Verification

We may require additional verification (e.g., email/SMS confirmation, ID/age verification) and may cancel or delay orders pending review. We may refuse service, limit quantities, or block accounts at our discretion.

 

 

Shipping, Delivery, Title & Risk of Loss

We partner with trusted carriers. Title and risk of loss pass upon delivery to the shipping address provided (or to the carrier where you arrange shipment). Delivery times are estimates only and may be affected by carriers, customs, or events beyond our control. International shipments are DDU/Delivered Duty Unpaid unless otherwise stated at checkout.

 

 

Returns, Exchanges & Refunds

For hygiene and safety reasons, we cannot accept returns or exchanges on opened, used, or unsealed intimate items. See our Refund & Return Policy for details, timelines, and instructions. If your item is damaged, defective, or incorrect, contact us within 7 days of delivery.

 

 

Health & Safety (Non‑Medical)

Unless expressly labeled as a regulated medical device with required approvals/clearances, our products are consumer wellness products, not medical devices, are not intended to diagnose, treat, cure, or prevent any disease, and are not a substitute for medical advice. Always read and follow instructions; consult a healthcare professional if you have concerns. Stop use immediately if discomfort occurs.

 

 

Product Descriptions, Colours & Errors

We strive for accuracy but errors, inaccuracies, or omissions may occur (e.g., in descriptions, pricing, promotions, shipping charges, transit times, or availability). We reserve the right to correct errors, update information, or cancel orders if information is inaccurate at any time without prior notice (including after you submit an order).

 

 

Promotions, Discount Codes & Gift Cards

Promotions/codes are subject to the terms stated with the offer, are non‑transferable, may not be combined, and have no cash value. Minimum spend, expiry, and region limits may apply. Gift cards are issued in the shown currency, are non‑refundable, and cannot be redeemed for cash except as required by law.

 

 

Subscriptions & Recurring Billing

We may offer subscriptions in the future. If you enroll, you authorize recurring charges until cancellation. You can cancel in your account before the next billing date. Promotional rates may revert to standard rates after the promotional period.

 

 

Optional Tools

We may provide access to third‑party tools on an "as is" and "as available" basis without warranties and without endorsement. We are not liable for your use of such tools. Use at your own risk and after reviewing the third‑party terms.

 

 

Third‑Party Links

The Services may contain third‑party content or links. We are not responsible for examining or evaluating third‑party materials or websites and are not liable for any harm or damages arising from your access or transactions with third parties. Review third‑party policies before engaging.

 

 

Relationship with Shopify

beU is powered by Shopify, which enables us to provide the Services. However, sales are made directly between you and beU. Shopify is not responsible for sales, products, or services offered by beU. You expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with beU.

 

 

Privacy Policy

Personal information collected through the Services is subject to our Privacy Policy (link provided on the Site). Because the Services are hosted by Shopify, certain data about your access to and use of the Services is processed by Shopify in accordance with its privacy policy. Information you submit may be processed in countries other than where you reside. See our Privacy Policy for details.

 

 

User‑Generated Content, Feedback & Reviews

If you submit ideas, suggestions, feedback, reviews, photos, or other content (collectively, “Feedback/UGC”), you grant beU a perpetual, worldwide, transferable, sublicensable, royalty‑free license to use, reproduce, modify, publish, distribute, display, and otherwise exploit such content in any media for any purpose, including commercial use and marketing. You represent that you own or control the rights to your content, disclose any compensation or incentives, and that your content complies with these Terms and applicable law. We may moderate or remove content in our discretion. You may not misrepresent your identity or provide misleading information.

 

 

Intellectual Property; Notice of Infringement

All Site content (text, graphics, logos, photos, product names/designs) is owned by or licensed to beU Global Inc. and protected by IP laws. You may not copy, modify, reverse‑engineer, or distribute without permission.
Notice of claimed infringement: Email Support@HeybeU.com with (a) your contact details, (b) identification of the work claimed to be infringed, (c) the allegedly infringing material and its location, (d) a good‑faith statement, and (e) a statement under penalty of perjury that the information is accurate and you are authorized to act.

 

 

Prohibited Uses

You agree not to: (a) violate laws or third‑party rights; (b) upload harmful, obscene, or defamatory content; (c) attempt unauthorized access or interfere with security; (d) scrape/harvest data; (e) send spam or deceptive marketing; (f) impersonate others; (g) upload malware; (h) misuse products in unsafe, unlawful, or non‑intended ways; or (i) engage in conduct that restricts or harms others' use of the Services. We may suspend or terminate accounts for violations.

 

 

Limited Warranty

We uphold high quality standards (e.g., premium medical‑grade silicone and high‑grade ABS where specified). We provide a 1‑year limited warranty covering functional issues caused by manufacturing defects. Exclusions include misuse, accidents, improper storage/cleaning, normal wear and tear, cosmetic issues, unauthorized modifications, and failure to follow instructions. Remedies are repair, replacement, or refund at our discretion. This warranty gives specific legal rights and does not affect rights under applicable consumer laws.

 

 

Limitation of Liability

To the fullest extent permitted by law, beU and its affiliates, officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability for any claim relating to your purchase or use of the Site will not exceed the greater of CAD/USD 100 or the amount you paid to us for the product giving rise to the claim in the 12 months preceding the event. Nothing limits rights that cannot be excluded under applicable consumer‑protection laws (e.g., mandatory EU/UK/AU consumer rights).

 

 

Warranty Disclaimer

Except as required by law and our Limited Warranty, the Services, Site, and products are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee that use will be uninterrupted, timely, secure, or error‑free. Some jurisdictions do not allow certain disclaimers; those limits apply to you.

 

 

Indemnity

You agree to indemnify, defend, and hold harmless beU (and Shopify, and our/its affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers) from losses, damages, liabilities, claims, and reasonable legal fees arising out of your breach of these Terms, violation of law or third‑party rights, or misuse of the Services or products. We may control the defense/settlement of any claim; you will cooperate.

 

 

Termination

We may terminate or suspend the Services or your account at any time, with or without notice, for any reason, including violations of these Terms. You remain liable for amounts due up to the termination date. Sections intended to survive (including IP, Feedback/UGC, Warranty Disclaimer, Limitation of Liability, Indemnity, Severability, Waiver/Entire Agreement, Assignment, Governing Law/Dispute Resolution, and Privacy) will survive termination.

 

 

Governing Law, Venue & Dispute Resolution

Default (non‑U.S.): These Terms are governed by the laws of Ontario, Canada. Courts in Toronto, Ontario have exclusive jurisdiction, except that consumers may also benefit from mandatory rights in their own country/state.
U.S. customers — Arbitration & Class‑Action Waiver:

  • Agreement to Arbitrate: Any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • Opt‑out: You may opt out within 30 days of purchase by emailing Privacy@HeybeU.com with the subject "Arbitration Opt‑Out" and your order number.

  • Small‑Claims: Either party may bring an individual claim in small‑claims court.

  • No Class Actions: Arbitration proceeds on an individual basis; class actions and class‑wide arbitration are not permitted.

  • Severability: If any arbitration/class‑waiver term is found unenforceable, the remainder stays in effect.



Export Controls & Sanctions

You may not use, export, or re‑export products in violation of applicable export laws and sanctions regulations. You represent you are not located in a prohibited country or on a restricted list.

 

 

Electronic Communications; Notices

By using the Services, you consent to receive communications electronically (e.g., email, SMS if opted‑in) and agree that electronic agreements, notices, and disclosures satisfy legal requirements. Legal notices to beU must be sent to the address in Who we are.

 

 

Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, labor disputes, pandemics, supply‑chain disruptions, or carrier interruptions.


 

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.

 

 

Severability

If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

 

 

Waiver; Entire Agreement

Our failure to enforce any right or provision is not a waiver. These Terms, together with our Privacy Policy, Refund & Return Policy, and Shipping Policy, constitute the entire agreement between you and beU regarding the Services and products and supersede prior agreements.

Headings are for convenience only and do not affect interpretation.

 

 

Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new “Last updated” date and notified as required by law. Your continued use after changes constitutes acceptance of the revised Terms.

Regional Addenda

 

Canada (CA)

  • Privacy: PIPEDA applies; we explain purposes, obtain appropriate consent, and provide access/correction rights as described in our Privacy Policy.

  • Marketing: CASL requires consent, sender identification, and an easy unsubscribe for commercial electronic messages.

  • Consumer: Provincial laws (e.g., Ontario Consumer Protection Act) may mandate disclosures and remedies. No general statutory cooling‑off for ordinary online sales unless specified.

  • Accessibility: We aim to align with AODA/WCAG for Ontario users.

 

United States (US)

  • Privacy: CCPA/CPRA provide rights to access, delete, correct, and opt‑out of sale/share/targeted advertising; we honor Global Privacy Control (GPC) signals as described in our Privacy Policy.

  • SMS: The TCPA requires prior express written consent for marketing texts; we provide STOP/HELP and maintain consent logs.

  • Fulfilment: We follow the FTC Mail, Internet, or Telephone Order Merchandise Rule for shipping delays/refunds.

 

European Union / EEA (EU/EEA)

  • Privacy: GDPR applies; we specify lawful bases, provide rights (access/erasure/objection/portability), and use SCCs or other transfer mechanisms where needed. An EU representative may be appointed if legally required.

  • Cookies: ePrivacy requires opt‑in consent for non‑essential cookies.

  • Distance selling: 14‑day withdrawal right under the Consumer Rights Directive, with no withdrawal for unsealed hygiene/intimate goods once unsealed after delivery (Art. 16(e)). See the Model Withdrawal Form below.

 

United Kingdom (UK)

  • Privacy: UK GDPR and PECR apply; consent is required for non‑essential cookies per ICO guidance.

  • Distance selling: 14‑day cancellation under the Consumer Contracts Regulations (CCR), with an exception for unsealed hygiene/intimate goods (Reg. 28). The Model Cancellation Form is provided below.

 

Australia (AU)

  • Privacy: The Privacy Act 1988 (APPs) governs personal information; OAIC guidance applies.

  • Consumer: The Australian Consumer Law (ACL) provides guarantees and remedies for faulty goods that cannot be excluded.

  • Marketing: The Spam Act 2003 requires consent, sender ID, and unsubscribe for email/SMS marketing.
